Introduction

  1. These Terms and Conditions (“Agreement”) govern the use of the Saint Lucia Fisheries Data Library (“Library”) by users (“Users”). By accessing or using the Library, Users agree to be bound by this Agreement.
  2. The Library is owned and maintained by the Saint Lucia Fisheries Department (“Department”).

Access to the Library

  1. Access to the Library is granted to Users who agree to abide by the terms of this Agreement and comply with any relevant laws.
  2. The Department reserves the right to modify or terminate access to the Library at any time and without notice.

Use of Library Content

  1. All content provided by the Library is owned by the Department and is protected by Saint Lucia and international copyright laws.
  2. Users may access and use Library content for non-commercial purposes only.
  3. Users may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Library without the express written permission of the Department.
  4. Users must credit the Department as the source of any information obtained from the Library.

Accuracy of Information

  1. The Department strives to provide accurate and up-to-date information in the Library, but makes no representations or warranties of any kind regarding the accuracy, completeness or suitability of the information provided.
  2. Users are solely responsible for verifying the accuracy and completeness of any information obtained from the Library before using it.

Privacy

  1. The Department is committed to protecting the privacy of Library Users.
  2. The Department may collect and use personal information about Users for the purpose of improving the Library or communicating with Users about Library-related matters.
  3. The Department will not sell or disclose any personal information about Users to third parties unless required by law or necessary to provide Library-related services.

Disclaimer of Warranties and Limitation of Liability

  1. The Library is provided “as is” and the Department makes no representations or warranties of any kind, express or implied, regarding the Library or its contents.
  2. In no event shall the Department be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the use of the Library or any content obtained from the Library.

Indemnification

  1. Users agree to indemnify and hold harmless the Department and its officers, agents, and employees from any and all claims, damages, expenses, or losses arising out of the User’s use of the Library.

Governing Law and Jurisdiction

  1. This Agreement shall be governed by and construed in accordance with the laws of Saint Lucia.
  2. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.

Changes to Terms and Conditions

  1. The Department reserves the right to modify these Terms and Conditions at any time and without notice.
  2. Users should check these Terms and Conditions periodically for changes.

Entire Agreement

  1. This Agreement represents the entire understanding between the Department and Users regarding the use of the Library and supersedes all prior agreements and understandings.
  2. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
